Terms and Conditions | Penguin Swim School
1. General Terms
By enrolling in swimming lessons at Penguin Swim School, students, parents, and guardians agree to abide by these Terms and Conditions. These terms apply to all participants engaging in our services. Payment of fees constitutes acceptance of these terms.
Penguin Swim School reserves the right to update these terms at any time without prior notice. Any changes will be reflected on our official website.
2. Reservation & Payment Policy
- Class slots will be held for 3 days after registration. To confirm your booking, full payment for the first set of 4 lessons must be made within this period.
- Payments must be made electronically via PayNow or bank transfer.
- For ongoing lessons, payment must be made in full before the start of each set of 4 lessons.
- Invoices will be sent via WhatsApp/Email, and payment must be made within 7 days of issuance. Failure to pay on time will result in a suspension of lessons until the outstanding balance is settled.
- Overdue payments that remain unpaid for 30 days may be subject to legal action.
3. Class Policies & Attendance
3.1 Group Class Policies
- Lessons are conducted at both private and public swimming pools across Singapore.
- Classes will be held rain or shine. In cases of heavy rain, lightning risks, or a PSI above 150 (poor air quality), alternative land-based drills will be conducted in a sheltered area.
- No refunds or replacements will be provided for lessons affected by weather conditions.
- No lessons will be conducted on Public Holidays or during the 5th week of the month (if applicable)
3.2 Private Class Policies
- A minimum of 2 hours’ notice is required for cancellations or rescheduling.
- If a student misses a lesson without prior notice, the lesson will be forfeited with no replacement or refund.
- Private lessons must be scheduled in advance and are subject to coach availability.
4. Cancellation & Replacement Policy
Group Lessons:
- All 4 lessons must be completed within 45 days from the first scheduled lesson. Any unused lessons beyond this period will be forfeited.
- No refunds or replacement classes will be provided, except for medical reasons (with a valid Medical Certificate submitted within 24 hours of the missed lesson).
Private Lessons:
- A minimum of 2 hours’ notice is required for cancellations. Failure to provide notice will result in the lesson being forfeited.
- All 4 lessons must be completed within 45 days from the first scheduled lesson.
- Replacement lessons for medical-related absences must be utilized within 45 days, subject to coach availability.
5. Student Safety & Assumption of Risk
- Students and parents acknowledge that swimming is a physical activity that carries inherent risks.
- While Penguin Swim School and its instructors take necessary safety precautions, we are not liable for any injuries, accidents, or health issues that may occur before, during, or after lessons.
- All students must follow the instructor’s guidance and adhere to pool safety regulations at all times.
6. Adverse Weather Policy
- Instructors may cancel or postpone lessons due to adverse weather conditions (e.g. rain, lightning).
- For lessons at condominium pools, clients must notify the instructor at least 2 hours in advance if they wish to cancel.
- If the coach is already at the venue, the lesson will be considered completed.
- Canceled lessons due to adverse weather may be rescheduled within the 45-day lesson completion period, subject to coach availability.”
7. Parental/Guardian Responsibility
- For students under 12 years old, a parent or guardian must be present at the lesson location.
- Parents/guardians are responsible for ensuring that their child is physically fit to participate in swimming lessons. Any medical conditions must be disclosed before starting lessons.
8. Coach Assignment & Engagement
- Coach assignments are based on availability and student needs.
- Parents/students are not allowed to directly engage our instructors for private lessons outside of our school’s program. Any such engagement will result in immediate termination of services.
9. Conduct & Disciplinary Action
- Students and parents are expected to behave respectfully during lessons.
- Disruptive behaviour, including refusal to follow safety instructions, may result in removal from the lesson without a refund.
10. Photography & Media Consent
- Penguin Swim School may take photos or videos during lessons for training and promotional purposes.
- If you do not wish to be featured, please inform us in writing before the start of your lessons.
11. Limitation of Liability
- Penguin Swim School is not responsible for lost or damaged personal belongings before, during, or after lessons.
- We are not liable for any injury, accident, or health condition occurring at the lesson venue.
- Participation in lessons is at your own risk.
12. Refund Policy
- All lesson fees are strictly non-refundable.
- In exceptional circumstances, refunds may be granted at Penguin Swim School’s sole discretion.
- If a student wishes to discontinue lessons, a minimum notice of 4 lessons is required to allow for scheduling adjustments.
13. Class Scheduling & Venue Changes
- Requests to change class times or venues must be made in writing via WhatsApp (+65 8909 4656).
- Changes are subject to availability. If no immediate change can be made, students may be placed on a waitlist.
14. Instructor Credentials
- All instructors are certified by recognized organizations, such as:
- AUSTSWIM
- National Registry of Coaches (NROC)
- Swimming Teachers’ Association (STA)
- Our coaches undergo extensive training in water safety and first aid to ensure high teaching standards.
15. Illness Policy
- Students should not attend lessons if they are unwell (e.g., cold, flu).
- Prolonged illnesses should be reported immediately to arrange for missed lessons.
- Any medical conditions must be disclosed during registration or as soon as they are identified.
